Software giant and entertainment maker, Microsoft has been litigated by a Chicago man who claims his super soaraway Xbox overheats and freezes up.

Robert Byers is aiming to get a class action which claims that Microsoft was in such a hurry to get the Xbox 360 onto the market before Nintendo that it sold a “defectively designed” product.

The lawsuit seeks unspecified damages and litigation-related expenses, as well as the replacement or recall of Xbox 360 game consoles.

Vole is insisting that there had only been a “very, very small fraction” of Xbox units that get overheated and besides that doesn’t like to talk about court cases.
